Understanding Underage Drinking And Driving Offenses (UDD) “Baby DUI” In Colorado
A driver under the age of 21 can be charged with a UDD (also known as “baby DUI”) if his or her blood alcohol content (BAC) at the time of arrest is higher than .02 but less than .05. If the BAC is .05 or higher, then the underage driver faces all of the penalties associated with a typical adult DUI.
- First conviction with BAC between .02 and .49: Penalties include three-month driver’s license suspension, fines of up to $100 and a sentence of community service.
- First conviction with BAC of .05 or more: Penalties include five days to one year in jail, fines of up to $1,000 and a driver’s license suspension of nine months.
- Second UDD with BAC between .02 and .49: Penalties include up to 90 days in jail, fines of up to $300, six-month driver’s license suspension and community service.
- Second UDD with BAC of .05 or more: Penalties include 10 days to one year in jail, fines of up to $1,500, a one-year driver’s license suspension and community service.
